Universities’ appeal against Tribunal decision to be heard November 2022

In May this year, the Copyright Tribunal published its decision regarding copyright fees payable by the 39 members of Universities Australia for 2019–22 (see our announcement here and the Tribunal’s decision here).
In July, the universities filed an application with the Federal Court seeking judicial review of several aspects of the Tribunal’s decision (see our announcement here). The application will be heard on 28 November 2022. The Federal Court usually reserves its decision in applications of this kind, and may not publish a decision until 2023.
In the meantime, we are invoicing at the rate set by the Tribunal, but the interim arrangements from 2019 will continue to apply, which means that only half the fees paid are available to us for distribution. The amounts held in escrow since 2019 will remain in escrow until the matter is resolved.
